Terms of Service

1. Who you are contracting with
JobProfit ("JobProfit", "we", "us", or "our") is operated by John Redding ("the Seller"). By creating an account, accessing, or using JobProfit (the "Service"), you ("you" or "User") agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. The Service
JobProfit is a software application for contractors to track jobs, labor hours, materials, quotes, invoices, and related business data. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan and these Terms.
3. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- Use the Service for any unlawful, fraudulent, or deceptive purpose;
- Send spam or transmit malware or other harmful code;
- Infringe any intellectual property, privacy, or other rights;
- Probe, scan, or test the vulnerability of the Service, or breach security or authentication measures;
- Scrape, harvest, or otherwise extract data from the Service in bulk;
- Interfere with or disrupt the integrity or performance of the Service.
4. Accounts and credentials
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date. Notify us immediately of any unauthorized use of your account.
5. Intellectual property
The Service, including all software, documentation, design, and branding, is owned by John Redding and is protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks or branding. You may not reverse engineer, decompile, copy, resell, redistribute, or circumvent any technical limitations of the Service.
6. Your content
You retain ownership of the content you upload or create in the Service (jobs, quotes, invoices, customer details, etc.). You grant us a limited license to host, store, and process that content solely as needed to provide the Service to you.
7. Payments, subscriptions and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, currency, cancellation and refund mechanics are governed by Paddle's Buyer Terms. JobProfit is offered as a monthly subscription that renews automatically until cancelled. You may cancel at any time from your billing settings or via paddle.net. See our Refund Policy for the refund window.
8. Service availability
We work hard to keep the Service available and reliable, but we do not guarantee that the Service will be uninterrupted, error-free, or completely secure. The Service is provided "as is" and "as available," and to the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Suspension and termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay applicable fees, create a security or fraud risk, or repeatedly or seriously violate our policies. Where reasonable, we will give you notice and an opportunity to fix the issue.
You may stop using the Service at any time. On termination, your right to access the Service ends. We will retain your data for a reasonable export window before deletion.
10. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or any liability that cannot be excluded under applicable law.
11. Indemnity
You agree to indemnify and hold harmless John Redding from any claims, damages, or expenses arising out of your content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.
12. Changes
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which John Redding operates, without regard to its conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction, except where mandatory consumer law provides otherwise.
